1. Seller
These terms of sale apply to purchases made on the XmasVibes website (xmasvibes.store), published by Mathieu Carpentier, sole proprietor (EI), trade name NAOMI, SIRET 892 739 111 00029, 231 rue Saint-Honoré, 75001 Paris, France. Contact: contact@xmasvibes.store.
2. Scope
These terms apply to every order placed on the website by a consumer. Placing an order means accepting them in full. The terms in force on the date of the order apply.
3. Products
Products are described as accurately as possible. Photos are for illustration only: slight variations in color or design may occur. Offers are valid while stocks last.
4. Prices
Prices are shown in the currency of your country (euros in France, US dollars in the United States). Shipping to France and the United States is free. The applicable price is the one displayed when the order is confirmed. Discounts shown on the site (for example when buying several items) are applied automatically in the cart. For orders shipped to the United States, any applicable sales tax is calculated at checkout.
5. Ordering
The customer selects products, checks the cart, enters their details and confirms payment. The order is final once payment is confirmed. A confirmation email summarizing the order is sent to the customer. The seller may cancel any order in case of a prior dispute or suspected fraud.
6. Payment
Payment is made online by credit card, Apple Pay, Google Pay, Shop Pay or PayPal, through secure providers. The seller never has access to the customer's card details.
7. Shipping
Orders are processed within 1 to 3 business days and delivered within an estimated 2 to 3 weeks, with tracking. Unless otherwise stated, delivery takes place no later than 30 days after the order. If delivery is late beyond that period, the customer may cancel the order. The customer should check the package on receipt and report any problem as soon as possible.
8. Returns
The customer has 14 days from receipt of the product to return it, without giving a reason, by notifying the seller by email at the address above. The product must be returned complete, in its original packaging, no later than 14 days after that notice. Return shipping costs are paid by the customer. The seller refunds all amounts paid within 14 days of being notified, and may wait until the product or proof of shipment is received. Refunds are made using the original payment method. The customer may be held responsible for any loss in value caused by handling beyond what is needed to check the product.
9. Warranty
All products are covered by the legal guarantee of conformity and the guarantee against hidden defects under French law. If a product is defective or does not match its description, contact us at the address above describing the issue (photos or video welcome) and we will repair, replace or refund it.
10. Liability
The seller cannot be held liable for misuse of the product or use not in line with its purpose. The customer is solely responsible for the audio content they load onto the product.
11. Personal data
The data collected is needed to process orders and is shared only with providers involved in fulfilling them (payment, preparation, delivery). The customer may access, correct, delete or object to the use of their data by email at the address above.
12. Disputes
In case of a complaint, the customer first contacts customer service. Failing an amicable solution, customers in the European Union may refer the matter free of charge to the consumer mediator listed in the Legal notice. These terms are governed by French law, without prejudice to any mandatory consumer protection rules of the customer's country of residence.
